Terms & Conditions

In this agreement, “you” or “your” refers to the purchaser, and “we”, “us”, or “our” refers to kiwilighter.co.nz and NZ Vase Ltd (the owner/operator of the website). (Kiwi Lighter)

1. General

This agreement applies to all purchases of products made through the kiwilighter.co.nz website and supersedes any prior agreements between you and us.

We reserve the right to amend these Terms & Conditions at any time in accordance with Clause 17 (Amendments).

2. Definitions

  • “Late payment interest rate” means 1.5% per month.

3. Purchase Terms

By placing an order, you confirm that:

4. Pricing

  • All product prices include GST unless otherwise stated.

  • Prices are subject to change without prior notice.

  • You are required to pay the full price quoted at the time of purchase.

5. Transit Costs

  • Product prices exclude shipping and handling charges.

  • Any applicable courier or delivery fees will be displayed at checkout and added to your total order amount.

6. Pricing Errors

If a pricing error occurs due to a system or computer issue:

  • We may require payment of the correct price difference.

  • If the error is identified before delivery, we will attempt to contact you.

  • You may choose to cancel your order if you do not accept the corrected price.

7. Product Availability

  • All products are subject to availability.

  • We are not responsible for stock shortages or inability to fulfil orders.

  • If we cannot supply part or all of your order, you may choose to cancel or modify it by mutual agreement.

  • Online availability and pricing may differ from physical store availability and pricing.

8. Delivery & Transit

  • Orders are processed and dispatched as per our shipping policy at the time of purchase.

  • Delivery times may vary due to factors beyond our control.

  • We are not liable for delays caused by external circumstances.

  • Claims for shortages or damaged goods must be reported within 3 days of receipt.

9. Payment Terms

Charges & Invoicing

  • Payment must be made in full at the time of order unless credit terms have been agreed.

  • If paying by credit card, you agree to cover any failure of payment by your card issuer.

  • If credit is granted, payment must be made within the agreed credit period.

  • We reserve the right to withdraw credit terms at any time.

Non-Payment Remedies

  • Interest of 1.5% per month will be charged on overdue amounts.

  • We may recover unpaid products.

  • You agree to cover all costs related to debt collection.

  • We are not liable for losses arising from recovery actions unless caused by negligence.

10. Warranties

We warrant that:

  • We have the legal right to sell the products.

  • Products are free from undisclosed security interests.

  • You will have undisturbed possession of the products.

Additionally, products will:

  • Be of acceptable quality.

  • Be fit for the intended purpose where applicable.

  • Match their description.

11. Cancellation, Returns, and Replacement

  • Orders cannot be cancelled after acceptance without our consent.

  • Cancellation may not be permitted once order processing has begun.

  • Returns are accepted at our discretion, and return shipping costs are the customer’s responsibility.

  • If cancellation is approved, a handling fee may apply.

Assignment

16. Notices

  • Notices are deemed received immediately if sent by email or within four days if sent by post.

17. Amendments

  • We may update these Terms & Conditions by providing notice via your preferred contact method.

  • Updated terms take effect from the date specified in the notice or within 30 days of notification.

18. Promotional Coupons

  • Coupons are valid for a limited time and may be modified or cancelled at any time.

  • Coupons are non-transferable and cannot be redeemed for cash.

  • Only one coupon may be used per order.

  • Returned items purchased with coupons will have the coupon value deducted from refunds.

  • Orders using invalid coupons may be cancelled.

  • Login or registration may be required for some coupons to be active.
